fa مبنای مشروعیت برنامه‌ریزان برای مداخله در شهر (با نگاهی به خانه پلنگ صورتی در خیابان طالقانی شهر تهران) The Basis of Planners’ Legitimacy to Intervene in the City (A Reflection on the “Pink Panther House” on Taleghani Street, Tehran) نقطه نظر/ سرمقاله Editorial پژوهشي Original Research Article شهرسازان (برنامه‌ریزان و طراحان شهری و منطقه‌ای) برای استفاده‌ی شهروندان از زمین‌های خودشان حکم صادر می‌کنند. یک طرح شهرسازی (مثلا یک طرح تفصیلی) ممکن است کاربری زمین را مشخص کند، یعنی بگوید در یک قطعه زمین مشخص چه فعالیتی می‌تواند صورت بگیرد و چه کارهایی نباید بشود. طرح‌های شهرسازی معمولا برای تراکم، سطح اشغال، تعداد طبقات، ارتفاع بنا، ابعاد و موقعیت نورگیر، تعداد پارکینگ مورد نیاز و گاهی حتی شیب رمپ پارکینگ ضابطه تعیین می‌کنند. پرسش این است که چه کسی به شهرسازان اجازه داده است که برای مردم تصمیم بگیرند؟ آیا مردم نسبت به املاک خود تسلط ندارند؟ اگر شهرسازان این اجازه را دارند، تا چه حد می‌توانند پیش بروند؟ مثلا آیا شهرسازان اجازه دارند ابعاد اتاق خواب را هم مشخص کنند؟ آیا مثلا می‌توانند رنگ کاغذ دیواری درون خانه را مشخص کنند؟ رنگ نمای بیرون از خانه را چطور؟ این اجازه‌ی مداخله، یا به بیان بهتر «مشروعیت» اظهار نظر برای املاک دیگران چطور برای شهرسازان ایجاد شده و مبنای آن چیست؟ شهریور ماه سال 1403، مالک یکی از خانه‌های نسبتا تاریخی (دوره‌ی پهلوی دوم) در شهر تهران تصمیم گرفت نمای خانه‌ی خود را صورتی کنند. این خانه که بعدها به «خانه‌ی پلنگ صورتی» مشهور شد، در خیابان طالقانی تهران، بحث‌های دامنه‌داری را در محافل تخصصی ایجاد کرد. آیا مالک ساختمان حق دارد نمای خانه‌ی خودش را به میل خودش رنگ کند؟ آیا دیگران (مثلا عابران یا همسایگان) حقی نسبت به این خانه دارند؟ آیا شهرسازان، یا مدیران شهری، حق دارند در خصوص رنگ این پلاک دستوری صادر کنند، یا حتی توصیه‌ای ارائه کنند؟ عده‌ای از متخصصان معتقد بودند که شهرداری باید مالک را وادارد تا به بافت اطراف احترام بیشتری بگذارد و حقوق عمومی را که بر این فضا مترتب است در نظر بگیرد. تغییر رنگ نمای یک خانه به معنای تغییر منظر خیابان است و چنین کاری نمی‌تواند صرفا در ید قدرت مالک یک خانه باشد. گروهی دیگر معتقد بودند که باید به آزادی و سلیقه‌ی فردی مالک احترام گذاشت و حتی اگر این بنا به نظر شهرسازان یا مدیران شهری زشت و بی‌ربط به بافت اطراف شده باشد، کسی اجازه ندارد در خصوص رنگ خانه‌ی دیگران اجباری ایجاد کند.   Urban and regional planners and designers issue binding decisions regarding how citizens may use their own land. An urban plan (for example, a city detailed plan) may determine land use, specifying which activities are permitted on a given parcel and which are prohibited. Urban plans typically set regulations for density, building coverage ratio, number of floors, building height, dimensions and placement of light wells, required parking spaces, and sometimes even the slope of parking ramps.The fundamental question is: who has granted planners the authority to make decisions on behalf of people? Do citizens not exercise control over their own property? If planners do possess such authority, how far may it extend? For instance, are planners allowed to determine the dimensions of bedrooms? May they specify the color of wallpaper inside a house? What about the color of the building’s exterior façade? How has this right of intervention (or more precisely, this legitimacy to pass judgment on others’ property) been established for planners, and what is its foundation?In September 2024, the owner of a relatively historic house (dating back to the second Pahlavi period) in Tehran decided to paint the façade of his house pink. This building, later known as the “Pink Panther House,” located on Taleghani Street, sparked extensive debate within professional circles. Does the owner of a building have the right to paint its façade according to personal taste? Do others (such as pedestrians or neighbors) have any rights in relation to this house? Do planners or urban managers have the right to issue directives, or even recommendations, regarding the color of this property?Some experts argued that the municipality should compel the owner to show greater respect for the surrounding urban fabric and consider the public rights associated with this space. Changing the color of a house façade effectively alters the streetscape, and such an action, they claimed, cannot remain solely within the authority of a single property owner.
